DWI PENALTIES IN NEW YORK

The penalties for adult drivers for a conviction for Driving While Under the Influence  (DWI) and driving while impaired by drugs (DWAI-drug) misdemeanor, with a blood alcohol content of .08 are:

  • Up to a $1,000 fine
  • Up to one year in jail
  • Minimum of six-month’s revocation of your driver’s license

For a second-offense DWI or DWAI (Driving While Ability Impaired) within 10 years, class E felony:

  • Up to a $5,000 fine
  • Up to four years in jail
  • Minimum one-year revocation of your driver’s license

For a third-offense DWI or DWAI within 10 years, class D felony:

  • Up to a $10,000 fine
  • Up to seven years in jail
  • Minimum one-year revocation of your driver’s license

The penalties for drunk driving highly go up if your blood alcohol content is higher, if there is an accident, or if there were serious injuries or a fatality involved.
